Effective January 1, 2016, House Enrolled Act ("HEA") 1265, otherwise known as the Caregiver Advise, Record, and Enable Act, or CARE Act, requires hospitals to collect certain information from admitted inpatients who wish to identify a lay caregiver. This individual would provide medical assistance to the patient in the patient's home following discharge from the hospital. The CARE Act requires the hospital to issue an "at home care plan" to the patient describing the assistance the patient will need from the lay caregiver in the home and will require the hospital to provide a consultation with the lay caregiver regarding the patient's home care needs prior to the patient's discharge from the hospital. Under certain circumstances, the hospital may also need to provide other notifications and additional education to the lay caregiver prior to the patient's discharge.
